IoT Contracts. An Empirical Research

An empirical research on the contracts used in the Internet of Things to point out the most relevant contractual issues and the main dangers for customers of IoT products. In my opinion, in the IoT the notion itself of product changes and therefore there will be a revival of the product liability regime, which from now on will apply not only to hardware, but also to software and service.
Product liability from a comparative perspective. What kinds of protection?

This research aims to analyse English and Italian rules in matters of product liability exploring differences and analogies between the two considered legal systems. Since the Donoghue v Stevenson case (1932) in English Law and the Saiwa case (1964) in Italian Law, both House of Lords and Court of Cassation judgments confirm the extraordinary relevance of food in opening up new frontiers of liability. The research discloses that the current legal framework in this area is still fragmented and rather unsatisfactory and that the significant differences between national consumer laws in the jurisdictions of the trader and the consumer may deter them from transacting across borders.

The article tackles the issue of protection of personal data of internet users through the usage of cookies by digital content and service providers. It analyses the European legislative framework and, in particular, the General Data Protection Regulation, the so called E-Privacy Directive and the new Directive concerning the supply of digital content and services. The contribution debates the role of individual consent in this field and the interaction with the rules and the remedies provided by European Consumer Law, such as the Unfair Commercial Practices Directive, in order to protect user's personal data in the evolution of data-driven economy.

Uno dei compiti più importanti è l’implementazione di un consumo sostenibile. In questo contributo, si tratterà di verificare come il diritto dei consumatori possa aiutare a raggiungere questo obiettivo.
